Terms and Conditions
These terms and conditions apply to all quotations, offers and contracts for the supply of goods by Forentina&Linet.
1.1 This agreement is between Forentina&Linet (hereinafter called THE SALES COMPANY) and any client or clients (hereinafter called THE CUSTOMER) purchasing a product.
• 1.2 A total upfront payment is required prior to any product being manufactured.
• 1.3 Delivery is provided on the order and confirmed within 2 days of the date of purchase.
2 Cancellations and Refunds.
• 2.1 Cancellation: No order which has been accepted by the seller may be cancelled by the buyer unless agreed in writing by the sales company and on condition that the buyer shall indemnify the seller in full against all loss, costs, damages, charges and expenses incurred by the sales company as a result of cancellation.
2.2 The customer has 1 working day to cancel the order. This must be in writing to the sales company.
3. General
• 3.1 The sales company will make every effort to meet delivery dates but cannot accept responsibility for any delays beyond their control.
• 3.2 The sales company reserves the right to substitute alternative materials to those specified, with other of equal quality and suitability.
• 3.3 Any variations or alterations to the specification or quotation requested by the client will be charged on a time and material basis.
• 3.4 The title of the goods does not pass to the customer until full settlement of the customer account has been made. The sales company reserves the right to recover goods for which full payment has not been paid.
• 3.5. Prices: The price of the goods shall be as set out in the quotation or where no price has been quoted, in the price list of the seller at the time of delivery and shall be based on the costs ruling at the date of acceptance by the seller of the order from the buyer. Unless otherwise stated in writing, prices include packaging, carriage and insurance, but the seller reserves the right to charge for these where the buyer requests part delivery or delivery to more than one location. Packaging shall be to reasonable industry standard. All prices are exclusive of value added tax, import duties and local taxes, for which the buyer shall be liable.
• 3.6. Risk & Title i. Risk of damage to or loss of the goods shall pass to the buyer on delivery. By accepting delivery, the buyer warrants that the goods have been delivered complete in accordance with the delivery documentation and in acceptable condition, unless otherwise evidenced in writing within 48 hours of receipt of delivery. Notwithstanding delivery and passing of risk, the goods shall remain the property of the seller until such time as the buyer shall have paid the seller in full for all contracts. Until such time as title in goods passes to the buyer, the seller shall be entitled at any time to require the buyer to deliver up the goods to the seller and, if the buyer fails to do so forthwith, to enter upon any premises of the buyer or any third party where the goods are stored and repossess the goods. ii. At the sellers discretion the seller may pursue an action against the buyer for the price of the goods not withstanding that title in the goods has not passed to the buyer.
• 3.7. Assignment: The buyer may not assign or transfer any rights or obligations under the contract without prior agreement in writing by the seller. The seller may assign or subcontract any contact.
• 3.8. Force Majeure: The seller shall not be liable to the buyer or be deemed to be in breach of any contract with the buyer by reason of any delay in performing or any failure to perform any of the obligations of the seller in relation to the goods if the delay or failure was due to force majeure or to any other cause beyond the reasonable control of the seller.

Returns and Refund Notice
• 1.1 This agreement is between Forentina&Linet (hereinafter called THE SALES COMPANY) and any client or clients (hereinafter called THE CUSTOMER) purchasing a product.
1.1 The Sales company does not accept returns or give refunds due to the bespoke nature of the goods.
1.2 In the event the goods are damaged then the sales company will replace these products in full and to the new delivery date provided upon full receipt of evidence of the damaged goods on arrival.
1.3 The customer has 2 working days from delivery to provide evidence showing the damage. The customer can return the goods at their own postage expense as evidence.
1.4 Once evidence is received of damaged goods and the the Sales Company are satisfied that the goods were damaged prior to leaving manufacturing facility they will issue notice or replacement of the product(s). They have 5 working days to provide this information.
2 Cancellations.
• 2.1 Cancellation: No order which has been accepted by the seller may be cancelled by the buyer unless agreed in writing by the seller and on condition that the buyer shall indemnify the seller in full against all loss, costs, damages, charges and expenses incurred by the seller as a result of cancellation.
2.2 The customer has 1 working day to cancel the order. This must be in writing to the sales company.

What is the purpose of this privacy notice?

2. THE PERSONAL DATA WE COLLECT ABOUT YOU

Nor do we collect any information about criminal convictions and offences.
If you fail to provide personal data
Where we need to collect your personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
• Performance of Contract this means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
• Legitimate Interest this means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). 6. INTERNATIONAL TRANSFERS
Many of our external third parties are based outside the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the EEA.
Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by implementing safeguards:

By law we have to keep basic information about our customers (including contact, identity, financial and transaction data) for six years after they cease being customers for tax purposes.

9.YOUR LEGAL RIGHTS
Unless subject to an exemption under the data protection laws, you have the following rights with respect to your personal data:
• The right to request a copy of the personal data which we hold about you;
• The right to request that we correct any personal data if it is found to be inaccurate or out of date;
• The right to request your personal data is erased where it is no longer necessary to retain such data;
• The right to withdraw your consent to the processing at any time, where consent was the lawful basis for processing your data;
• The right to request that we provide you with your personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), where applicable 9i.e. where our processing is based on consent or is necessary for the performance of our contract with you or where we process your data by automated means);
• The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing;
• The right to object to our processing of personal data, where applicable i.e. where processing is based on our legitimate interests (or in performance of a task in the public interest/exercise of official authority); direct marketing or processing for the purposes of scientific/historical research and statistics).

No fee required – with some exceptions
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable admin fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
10. Changes to this notice and your duty to inform us of changes
This version was last updated on 09/02/2022
From 25 May 2018 there will be changes in data protection laws and we will then be able to respond to some of your requests (for example, a request for the transfer of your personal data). We are still working towards getting our systems ready for some of these changes.
Please keep us informed if your personal data changes during your relationship with us. It is important that the personal data we hold about you is accurate and current.
